Please stop by the Front Desk to receive a username and password to use the 'SDYC' network.  If you have trouble connecting while on your boat down below, try connecting up on deck.  And you can always visit the Members Lounge to the right of the lobby as a comfortable place to use your laptop.  For additional support, contact it@sdyc.org.

TERMS OF USE

By connecting to this “WAP” you agree that you have read, understand and agree to be bound by the following Terms of Use.

San Diego Yacht Club provides access to the WAP service at certain locations that have been equipped with wireless access points. Access points or wireless enabled locations may not be available in all areas of the San Diego Yacht Club, and may not always be operational.

San Diego Yacht Club does not screen or restrict access to any content placed on or accessible through the Internet. San Diego Yacht Club also does not screen or restrict communications between parties via the Internet. You acknowledge that if you access the Internet you may receive or be exposed to content, goods or services which you consider to be improper, inaccurate, misleading, defamatory, obscene or otherwise offensive. You agree that San Diego Yacht Club is not liable for any action or inaction with respect to any such content on the Internet accessible through the WAP service. You acknowledge that this WAP service is not inherently secure and that wireless communications can be intercepted by technology designed and intended for that purpose. You agree that San Diego Yacht Club will not be liable to you or any other party for any lack of security that may result from your use of the WAP service.

You must (1) provide all equipment (including computer hardware and software, personal digital assistants, wireless network cards, etc.) to connect to the WAP service, (2) comply with local, state, federal and international laws and regulations, including but not limited to copyright and intellectual property rights laws. You agree to be responsible for and to bear all risk and consequences for (1) the accuracy, completeness, reliability and/or usefulness of any content available through the WAP service and (2) all communications that you send or receive via the WAP service. San Diego Yacht Club does not undertake the security of any data you send through the WAP service and it is your responsibility to secure such data. You further agree that you are responsible for providing security measures that are suited for your intended use of the WAP service. For example, you shall take full responsibility for taking adequate measures to safeguard your data from loss.

You agree that you will not upload, post, or otherwise distribute or facilitate distribution of any content -- including text, communications, software, images, sounds, data, or other information -- that: is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of another's privacy, tortuous, contains explicit or graphic descriptions or accounts of sexual acts (including but not limited to sexual language of a violent or threatening nature directed at another individual or group of individuals), uses vulgar language in the creation of a Screen Name (AIM) or otherwise violates San Diego Yacht Club's rules or policies or these “WAP” Terms of Use; victimizes, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability; infringes on any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right of any party; constitutes unauthorized or unsolicited advertising, junk or bulk email (also known as "Spamming"), chain letters, any other form of unauthorized solicitation, or any form of lottery or gambling; contains software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of any third party; or impersonates any person or entity, including any employee or representative of San Diego Yacht Club.

You also agree that you will not harvest or collect information about other users connected to this “WAP” or use such information for the purpose of transmitting or facilitating transmission of unsolicited bulk electronic e-mail or communications.

You further agree that you will not knowingly solicit or collect personal information from a minor (anyone under 18 yrs old). Personal information includes but is not limited to name, address, phone number or name of their school.

San Diego Yacht Club generally does not pre-screen, monitor, or edit the content posted by users of communications services, chat rooms, message boards, newsgroups, software libraries, or other interactive services that may be available via this “WAP”. However, San Diego Yacht Club and its agents have the right at their sole discretion to request the removal of any content that, in San Diego Yacht Club's judgment, does not comply with the “WAP” Terms of Use or is otherwise harmful, objectionable, or inaccurate. San Diego Yacht Club is not responsible for any failure or delay in removing such content. You agree that San Diego Yacht Club may cancel your access to the WAP service at any time, without notice and for any reason including, but not limited to, violation of any of the terms and conditions of these Terms of Use, security or safety reasons, and/or using the WAP service to perform any illegal activity. You further agree that in the event of termination for any reason, San Diego Yacht Club will have no liability to you.

YOU SHALL DEFEND, INDEMNIFY AND HOLD SAN DIEGO YACHT CLUB AND ITS CORPORATE AFFILIATES AND THEIR RESPECTIVE OFFICERS, DIRECTORS, STOCKHOLDERS, EMPLOYEES, CONTRACTORS, AGENTS, SUCCESSORS AND ASSIGNS HARMLESS FROM AND AGAINST, AND SHALL PROMPTLY REIMBURSE THEM FOR, ANY AND ALL LOSSES, CLAIMS, DAMAGES, SETTLEMENTS, COSTS, AND LIABILITIES OF ANY NATURE WHATSOEVER (INCLUDING REASONABLE ATTORNEYS' FEES) TO WHICH ANY OF THEM MAY BECOME SUBJECT ARISING OUT OF, BASED UPON, AS A RESULT OF, OR IN ANY WAY CONNECTED WITH, YOUR USE OF THE WAP SERVICE OR ANY BREACH OF THIS AGREEMENT.

THE WAP SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND. SAN DIEGO YACHT CLUB DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. SAN DIEGO YACHT CLUB MAKES NO EXPRESS WARRANTIES AND CUSTOMER WAIVES ALL IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE, NON INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE REGARDING ANY MERCHANDISE, INFORMATION OR SERVICE PROVIDED THROUGH SAN DIEGO YACHT CLUB OR THE INTERNET GENERALLY. CUSTOMER EXPRESSLY ACKNOWLEDGES THAT THERE ARE, AND ASSUMES ALL RESPONSIBILITY RELATED TO, THE SECURITY, PRIVACY AND CONFIDENTIALITY RISKS INHERENT IN WIRELESS COMMUNICATIONS AND TECHNOLOGY AND SAN DIEGO YACHT CLUB DOES NOT MAKE ANY ASSURANCES OR WARRANTIES RELATING TO SUCH RISKS. NO ADVICE OR INFORMATION GIVEN BY SAN DIEGO YACHT CLUB OR ITS REPRESENTATIVES SHALL CREATE A WARRANTY.

SAN DIEGO YACHT CLUB, ITS EMPLOYEES, AGENTS, VENDORS, AND LICENSORS ARE NOT LIABLE FOR ANY COSTS OR DAMAGES ARISING, EITHER DIRECTLY OR INDIRECTLY, FROM YOUR USE OF THE WAP SERVICE OR THE INTERNET, SPECIFICALLY INCLUDING ANY DIRECT, INDIRECT, INCIDENTAL, EXEMPLARY, MULTIPLE, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES.
